QUESTION

What will happen after I violated my probation for the first time?

Asked on Jan 27th, 2013 on Criminal Law - New Jersey
More details to this question:
I am on probation for burglary and due to end this May. I never violated before now. I got arrested for simple assault. I'm located in New Jersey. The judge put bail for $1500 and I paid and went home. When I got arrested they never said anything about me violating probation which I found weird. I had a fight with my wife but she didn't put any charges nor a restraining order. So instead on the yellow paper copy they gave me saying Domestic Violence, it said simple assault. So I'm worried what will happen to me since I do have my wife and kids. I don't know what to do from here. They told me I have court the 4th of Feb. Should I call my PO? Or is this a small court in my city as municipal court? Because my other courts were at the superior court.

Simple assault is handled in municipal court. However, if you plead guilty or are found guilty then you could be summoned for a violation of probation hearing. Several things could happen at the hearing, including a jail sentance. Or nothing could happen, if you're lucky. You will definitely want to retain an attorney to assist you in this.
