What will happen after receiving your second DUI 7 months from your first DUI?

More details to this question:
The father of my children received his first DUI February 2013 and second DUI September 2013. What kind of jail time is he looking at? Can I modify our current child visitation agreement being that he doesn't have a license to pick up? Do I notify the courts when/if he goes to jail?

You may want to file a motion to modify his visitation rights. If he has a drinking problem, you don't want him driving around with your child.

Depending upon what jurisdiction he is in, he could be looking at between 4 days to one year in jail. However, many jurisdictions offer alternatives to jail to where he would not be behind bars. In Texas it is a DWI not DUI if one is over 21. ? You can ask to have visitation modified so that he is not driving the children.? You can certainly ask to have him ordered not to drink within 24 or 48 hours of visitation.

He could get up to a year in jail if this happened in Michigan. Yes get the order modified so that there has to be a legally licensed and sober driver for the children.
