What will happen if an underage 17 year old is caught with heroin?

How much time in jail could the jail give her? 40 dollars worth of dope was caught on her.

Retain a good criminal lawyer to handle the case. In most cases a 17 year old will get Youthful Offender Treatment and drug court, diversion, or drug counseling. She will not have a criminal record or go to jail, but if she violates drug court rules or probation she will get a year in jail.

If waived into adult she would be facing maximum up to 5 years but there are diversion programs available. As a minor with a good lawyer you may be able to secure diversion.

In Michigan 17-year-olds are charged as adults. This is a very serious charge which can potentially land her years in prison. In Texas, under 17 is a juvenile unless the person is certified as an adult. There is a great chance that she will get probation.

A person possessing heroin could be charged with possession or possession with intent to distribute. If that person is 17 or younger, that charge would be brought in juvenile court. A juvenile cannot be sentenced to an adult correction facility. A juvenile court judge could sentence the juvenile to a lock down facility, but the time depends on the judge and the juvenile probation system.
