QUESTION

What will happen on an assault three charge?

Asked on Dec 20th, 2012 on Criminal Law - Louisiana
More details to this question:
My girlfriend got drunk. We had a minor fight. The neighbours called the cops and I left. She told the cops she was not pressing charges and was too drunk to give a statement. They made her give one. She also told the detectives she is not pressing charges and she was the one hitting on me.

Under the circumstances it is doubtful the DA will file if she is telling you the truth about what she told cops.

Well if she was saying that she was the one doing the assaulting then they will have a hard time charging or convicting you. That is if there are no other witnesses.

Her problems are bigger than an Assault 3, rather, it could be Assault 3 Domestic Violence.

The investigators will contact you to get a statement. You must absolutely refuse and exercise your right to remain silent. The moment you open your mouth to them, you've sealed your own fate.

This is a classic drunken assault situation. If this is an Eastern WA charge I can help you if you need me too. I handle all types of criminal cases throughout the Eastern WA State. Contact me and we will talk. I am sure there is a way to settle this matter or try it and win it.

Ultimately, the charge may be dismissed. However, the state can still proceed even if the victim later says she/he does not want to proceed.

Did you mean a third degree felony? You will probably be prosecuted and perhaps go to trial.
