What would be I be charged with for a first time offence?

More details to this question:
I was pulled over for a License Plate light being out, then was given a roadside test for DUI were I didn't pass, I chose to do the blood test and was given a breath test as well, I blew a .07.

In the state of Colorado, you may be charged with DWAI or DUI. You should consult with a DUI attorney in your area as soon as possible. You may have legal defenses to any charges brought by the government. In addition, you need to request a hearing through the DMV within 7 days of your arrest, barring some unforeseen reason.

I do not have all of the facts in your case, but it sounds like you will be charged with a DWAI and a defective tail lamp. The plea offer may be just to drop the defective tail lamp and plead guilty to the DWAI. A first time offense of DWAI typically carries with it 1 year of probation, alcohol classes, community services, court fines and costs.

Hopefully, the blood test will be even lower than the breath test. These cases can result in a non-alcohol (non-dui type)plea, but they take some work.
