In NJ, the conduct you describe is a disorderly persons offense (misdemeanor).  It will be handled in municipal court and can likely be reduced to a local ordinance violation which is not a criminal charge.  Essentially it's like getting a ticket for playing your stereo too loud.  The only penalty is a fine.

Your friend should be able to work this out with the owner of the apartment and the prosecutor. Your friend should not have any record at the end. We would negotiate with the owner of the apartment and with the prosecutor. Where did this happen ? When ? What were the actual charges ? trespassing ? We can represent your friend if he is not comfortable trying to do this without an attorney. Please call asap to discuss. No charge. Ed Dimon, esq. 732-797-1600
