QUESTION

When can I get off probation?

Asked on Dec 02nd, 2012 on DUI/DWI - Michigan
More details to this question:
Hello. I am on probation for an owi in Michigan. This is the first and only thing that is on my record. I have done 8 months of probation. I have attended all classes, done all community services. I also never fail a drug or pbt. I just paid off the rest of all my fees. I see my probation officer on Monday Dec. 3rd. I am supposed to be on probation until April. I was wondering if there was a chance I could be done with probation on Monday? Also, do they let people off very often in December because of all of the holidays coming up, or does that not matter. Thanks.

This will depend on the probation officer and the judge. All you can do is ask.

Depending on the court, many courts will let someone off probation after they have served half the probation time, plus one month. This is discretionary. Since you have done everything and have paid the fees, you should ask if you can have your probation over.

You can file a motion to terminate probation. The decision will really depend on the Judge and jurisdiction. Consult with an attorney to discuss this issue further.

The fact that the holidays are coming up typically has no bearing on your probation status. You can always ask your probabtion officer for an early release. It will be up to the probation officer and the court whether your request is granted.

Holidays do not matter and in fact are times when drinking and driving become more an issue. Ask for change to non-reporting.
