QUESTION

Which charge am I sentenced for and serve the probation for?

Asked on Nov 17th, 2013 on DUI/DWI - Washington
More details to this question:
If you're charged with vehicular assault, but after serving the sentence, you'll be given a DUI instead. Or is it a part thing, where you serve only some of the vehicular assault and it switches to DUI for the rest?

What you're describing sounds like a deferred sentence where you plead guilty to one charge and after you successfully serve your sentence, it will be reduced to a lesser charge at the end. Consider yourself fortunate if you received this for a DUI, particularly one with aggravating factors, as deferred sentences in those types of cases are extremely rare if not nearly impossible to get.

No such switch can take place without your consent. You either had an incompetent lawyer or no lawyer at all.
