Who decides if you're allowed to get into pre trial diversion?

More details to this question:
I was in trouble for grand thefy larseny and the state of Florida. My lawyer put in for pre trial diversion. Does the person stolen from dictate your outcome? I wasn't the actual person who stole. I was with the 2 idiots who did steal.
