Who may send a cease and desist letter?

This is a fictional scenario for a novel I'm writing. One of my characters, an attorney, is going to send a cease and desist letter to another character, citing harassment and demanding that all contact between the plaintiff and defendant cease. I was told that "cease and desist" might not be the proper terminology. Is a "cease and desist" letter the correct instrument in this case?

I think it is a general term, but to me it connotes a cease and desist order Here in PA, my letter would tell the person to stop the harassment or civil and criminal charges would be filed against them.
