It is entirely possible. In California, if convicted of any felony, you potentially face one or more years in prison, plus fines; on any misdemeanor, you potentially face up to 12 months in jail, plus fines. When questioned, arrested or charged with any crime, the proper questions are, can any evidence obtained in a search or statement be used against you, can you be convicted, and what can you do? If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

It depends upon your son's overall criminal history, and the facts of this particular case, but ultimately, it is up to the judge who imposes the sentence.

Depending on what degree of burglary is charged, your son can be sentenced to 1 to 6 years. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your son's case. He/she would then be in a better position to analyze his case and advise you of his options.

Yes. If this is a residential burglary he could go to prison but could given probation with a period of custody time in county jail and probably on work release as well.

This is an impossible question to answer. It depends on many factors - the county where it occurred, the evidence available to the prosecutor, whether it is a felony or misdemeanor (burglary is a 'wobbler'), and other issues. It is possible that he will end with a jail sentence but is also possible that it will not.

What is a 459pc? Burglary could get a prison sentence. Hire an attorney.
