QUESTION

Will a MISD citation show up on a background check?

Asked on Mar 06th, 2014 on Criminal Law - Missouri
More details to this question:
I was carrying a pistol concealed in my waistband when I was pulled over. Officers saw it and seized it. It is my gun, in my name, it is not stolen, I have no prior criminal record, and I am legally allowed to own firearms. I was carrying without a permit. I received a MISD citation for PC 25400 with the court day at the end of May. There were NO aggravating circumstances in my situation, I was simply unlucky. I was NOT arrested, officers confiscated my gun and let me leave. I have my final CCW interview next week. I have already been approved, all I need to do is pay my fees and submit my fingerprints for a LiveScan background check. Will this charge/ citation show up on that background check? Will it prevent me from getting my permit? Should I disclose this with law enforcement? If I do, will it disqualify me? When my day in court comes, will the DA pursue charges against me? What kind of plea deal might they propose? Will having a CCW help my chances at a dismissal? Again, I have not been to court yet. I have only just been given a ticket. Also officers confiscated my firearm, will I be able to get it back? I received a receipt, but everything I've read online says probably not. Please, I'm looking for any professional legal opinions that could help me or just better inform me on my situation. Thank you for your time.

Yes, misdemeanor convictions show up on a criminal background check. If you haven't been to court yet for this misdemeanor charge, then you haven't been convicted yet. Law enforcement will be able to see that you were charged with a misdemeanor, but only arrests and convictions show up on criminal background checks.
