QUESTION

Will a trial lower chance for supervision and lower fine for Class A Misdemeanor?

Asked on Dec 27th, 2012 on Traffic Violations - Illinois
More details to this question:
I was pulled over and cited on October 2012, 2 A.M., at Chicago 90 Skyway east bound going 85 mph on a 45 mph speed limit. I prefer going to trial without a lawyer because there is reason to suspect the equipment that was used has not been tested for accuracy. Secondly, the Illinois police officer did not follow the code of conduct in pulling me over because he allowed me to walk to his vehicle and threw me in the back of his car for a simple speeding citation. There is even more reason to suspect the officer did not follow procedures before using his Lidar equipment. I will have a witness, who was also in my vehicle at the time of citation, to prove that the officer did not follow the code of conduct. I would like explore my options for this Class A Misdemeanor because I currently have an expunge case in process. Will a trial lower my chances of obtaining supervision and a lowered fine? I would like to explore all options to avoid a conviction. Thank you, Patrick

Although one can always represent oneself, an attorney who can review the reports and consult with you can best prepare your case. Your issues are complex and this case may, in fact, depending on the outcome, complicate your request to have your prior case expunged.    Please contact an experienced criminal defense attorney as soon as possible.    This posting is for informational purposes only and should not be considered legal advice nor the establishment of an attorney-client relationship.
