Will BAC 0.13 might be able to have wet reckless?

More details to this question:
Bad experience, but my fault. I got caught at check point on the Redondo beach right after I had a dinner, and BAC result was 0.13. My court date is 2/6/12 at the Torrance court, and I really want to know I might get the wet reckless based on my BAC result. Now I'm attending DUI 3 month class(including AA)as a voluntary base because I thought that it might affect positively for my court result which is my lawyer recommended, but my lawyer said that my case is too generous so that nothing to appeal to the court. My physical test at check point is average or a little less average. I really need wet reckless.

Unlikely to get a wet reckless. You are close to double the cut off of .085.

You should be asking your own attorney. Might be able to have wet reckless. Quite unlikely. Generally requires less than .08 plus positive and sympathetic extenuating circumstances. Besides, the penalties and consequences are the same for it or DUI. It is something offered to get a plea from people who think they are getting a break.
