Will he be charged at a later date?

More details to this question:
My super drunk (.33) friend caused accident. Transported to hospital and released; cited only for no license not DWI. His blood was taken at the hospital (hence how he knows it was .33) but there is nothing in any citation that mentions DWI.

It was not a good idea for you to get into a car driven by a guy who had four times the legal limit in his system. He must have been noticeably drunk and you should have taken a taxi. You are lucky to be alive. He might get charged when the prosecutor gets the results of the blood test.

Yes, he can be prosecuted later, but he absolutely should talk to an attorney s out this. Why? Because if the citation is not superseded by a criminal filing and he resolves the ticket for driving without a license, the prosecution may be barred from filing additional charges from the same set of facts.

The DA is waiting to review the case with the blood results. It is unlikely that your friend will not be charged.

He can be charged later on and may receive a letter in the mail stating that charges have been filed against him and notifying him of his court date.

He may be charged, upon the review and discretion of the local prosecuting attorney. Generally, misdemeanor DWIs may be charged up to one year after the date of the occurrence. Felony DWIs may be generally charged up to three years after the date of occurrence.

He will probably be cahrged with something later after they get all the reports etc. Remember that he caused an accident so there is the possibility of a felony if anyone got hurt.

The police are probably waiting for the lab results. If it comes up as expected, they will then seek charges. You should hire an attorney to look into these issues and represent you when the charges are filed.

Once the prosecutor reviews the file, a DUI will be charged. What's on the ticket means nothing. Your friend better hire a DUI specialist soon, because he has only 10 days to save his license.

Most likely he will be. Sometimes it takes a few days for the notice to arrive in the mail from the police. Make sure the address on his Driver's License is accurate. Once it arrive, he should hire a lawyer to help him.
