More details to this question:
Driving and talking on Bluetooth, officer pulls me over with accusation of talking and driving. I moved the phone from seat to cup holder, and was ticketed for usage of wireless device.

You will not lose your license for the first violation. You will lose your license if there are multiple violations. You should explain the situation to the officer. You should purchase a 'hands free' device and show the officer. The officer will work with you. Ed Dimon
