QUESTION

Will I get jail time on a first time shoplifting charge?

More details to this question:
I am 20 years old and went into a store with a friend. He and I made a purchase and he then wanted to go back into the store as he said he forgot something. We went back into the store and he went to the condoms area and picked up a box and threw it in his bag and indicated, he does this all the time, we won't get caught and said do you need a box, I said, yes and threw a $28 box in my bag as well. We then left the store and was caught by the in store security. We were brought back into the store and the police were called. We now have to go to court in a few weeks. I have no problem pleading guilty, but am wondering if other than a fine, this being my first stupid offence, will there be jail time attached. Thanks for your time.

Very rarely will a defendant get jail on a first-time retail theft, especially when the product taken has a fairly minimal value.
