State of Texas. I have a conviction 10 years old for state jail felony/ third degree felony run concurrent in which I spent time in TDCJ Then 2 years ago i was charged with Class A misdemenor for switching tags on items $950 fine no probation or classes. Recently while shopping at walmart I left my son and basket full of groceries in the lobby to go get my credit card in the car. When approaching the building my son sees me and pushes the basket out of the store. Before I could tell him stop the store employees stopped him and asked me for my receipt at which time I stated I\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\'m on my way back in to pay bc I left my card in the car. they then said I was stealing the groceries I was taken to jail and had to bond out.

You have a great defense if your son testifies to what happened and is believable. Walmart has videos of everything so there will not be a question of what he did, only why he did it. You will get a chilly reception from the D.A. because of the record but that does not mean you are guilty. I have handled several cases where similar things have happened and we were able to get good results.
