I was sent home from labor detail once because I was 5 minutes late. Are they going to put me in jail when I go back? It was for a DWI, first offense, no other offenses ever. Thank you.
Some judges and some places are really strict about that. For example, if you are to report to jail at a certain time and you are a minute late they will not accept you and it is counted as a missed appointment or failure to appear. Consult with an experienced attorney in your area who has appeared before this particular judge to see what the likely outcome is on this matter.
Not sure what county your labor is, or the details behind your sentencing from the court, but I can give you a general idea. In LA county, absent other factors, community labor dept. would likely just tell you to come back on another scheduled day. Assuming you still completed your community labor requirements on time (and did not have continuous no shows), jail shouldn't be an issue. I would recommend contacting the community labor department t hat you initially enrolled through to make sure there are no further issues. It is possible they would require you to go back in front of the judge for re-enrollment or other issues, but I feel that is unlikely based on what you wrote and it is your first missed day. If that is the case though (you have to go back in front of the judge on this), you may want to consult with a local DUI attorney in your area.
You should hire a lawyer to go to court to recall the warrant and/or get re-enrollment papers. A lawyer can do this without you present, so it is less risky for you.
It does not seem very likely, but quite a lot of what is done in the 'corrections' system does not look terribly rational. It's a risk. But you probably have to come forward to avoid a worse outcome.
