It depends upon how you were charged, and whether or not you have prior convictions for marijuana possession, or other drug violations. In WI, if you were written a municipal citation, or a State forfeiture citation, jail is not on the table. If you were charged with?misdemeanor criminal possession, jail and/or probation are possible, but not mandatory. If you have a prior misdemeanor THC possession conviction, a second or subsequent offense can be charged as a felony, and a felony is by definition an offense that you can be sent to prison for, although again, that is not mandatory. If you have prior drug offenses, you may be subject to enhanced penalties as a drug repeater. If you are charged criminally, you need more than a free answer, you need a lawyer. If you can't afford one, go see the public defender, as soon as possible.
