Possibly. You want to get an attorney sicne that person can often work this charge down to something for which you will not get a further suspension of your license. DWLS carries a further suspension of your license is you are convicted.

Unless it is a subsequent offense or your license was suspended for an OUI, you should not get jail time. If it was either a subsequent offense or your license was suspended for OUI, yes, you certainly can be sent to jail.

It depends if it is a 1543 a or b. If your suspension was DUI related, then you better get good counsel to avoid a Mandatory 90 day jail sentence.

Every crime carries potential jail or prison upon conviction. Yours is a misdemeanor with up to a year in jail The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, expected testimony, priors history, etc. Raise all appropriate defenses with whatever witnesses, evidence and sympathies are available for legal arguments, for evidence suppression or other motions, or for trial. Effective plea-bargaining, using those defenses, could possibly reduce the potential ?time? and other penalties you face. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, program, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

Driving on a suspended license is a misdemeanor and can include jail time. However, in most cases it will be just a fine and probation. Some judges will allow you time to get your license and if you can they will reduce it down to the infraction of driving without a license.

Yes. If you have a VC 14601.2 charge (license was suspended based on DUI), even a first offense conviction has mandatory jail time. Speak to a DUI/criminal defense attorney in your area who can help mitigate damages, and possibly get the charge dismissed or reduced.

Possibly. It will depend on why your license was suspended. I suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.

Potentially that certainly is one of the penalties that a judge could impose. Get yourself an attorney.
