QUESTION

Will I have to pay back child support?

Asked on Oct 28th, 2011 on Criminal Law - Texas
More details to this question:
My ex-wife and I divorced in 2004 and we reconciled and moved back in together (didn't ever remarry) in 2006. I was paying child support out of my paycheck until I lost my job in 2008. When I lost my job, I never reinstated the child support with my new job because we were living together again. Now, almost 4 years later, we may be splitting again. Will I have to pay the child support that hasn't been paid in the time period we have been together and mutually agreed on?

You may have a difficult situation. It depends on the court where it is heard. You may owe for the back support since you did not modify the order. There is also the possibility that you may have a new common law marriage in which case you might not owe support.

I believe what is contained in the divorced judgment controls. There may be some extenuating circumstances due to your circumstances but I would consult with a lawyer to make sure.
