Without knowing all of the facts of your case, it is impossible to give you an accurate answer. You should be discussing this with your attorney, since (s)he knows more about your case, the judge, the D.A. and the court than anyone on this forum.

Instead of worrying about the jail time, you need to focus your attention on how you can avoid being convicted. ID theft is a crime of moral turpitude, and if convicted you can kiss your career aspirations goodbye. Hire a lawyer before you get duped into a plea you will regret for life.

If you have a lawyer why aren't you asking him this? He would be in a better position to know because he knows all the facts and who your judge is and we don't.

You will probably not get a jail term for your firs offense unless you stole a lot of money or are in a small town. You will probably get probation and restitution, but your lawyer is the one to ask.
