QUESTION

Will I have to take alcohol classes in order to get my license back?

Asked on Oct 02nd, 2012 on DUI/DWI - Arizona
More details to this question:
I am a resident of Arizona. I just moved to California only a few days ago and am trying to get everything sorted out. I am living with parents until new job begins to pay then Iโ€™ll be on my own again. I am trying to avoid having to clue them into the fact that this ever happened and that I may very well have to take classes before getting my license because they are dry people. They would be crushed to know otherwise in my life and they are pushing me to go take my test and get a license as soon as possible! What do I do? I sure hope that this single instance in my life does not require classes, because I'll never let it happen again, that's a fact! Thanks for your help!

You will have to comply will all CA DMV requirements, and CA court requirements before re-issuance of a license. That generally means alcohol classes required by the court and enforced by DMV. If you have not yet settled the court case, that still remains an open issue. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

If you now live in CA you will have to do the classes. It would be @ 17 weeks one time per week. I don't know how you will be able to deal with your parents. If you do not take the classes you will never get your license back.

Yes. California applies. The California court sets the sentence and the DMV is the same between California and Arizona. You may be able to take your class in Arizona but you should check with both DMVs.

You did not state why your license was taken away. If it was because of a DUI then yes, you will have to take alcohol classes. Your best option is to call AZ MVD and ask what you need to do to clear up your suspension.
