QUESTION

Will my probation be revoked if I drunk a little alcohol while having panic attacks?

More details to this question:
I was suffering from panic attacks and a little alcohol worked. I got help from a doctor and medicine. Iโ€™m on unsupervised probation for a driving while ability impaired. Iโ€™m almost through in October. I received a municipal charge for drinking in public.

Probably not. You should follow all instructions of your probation order.

Maybe, it depends upon the jurisdiction. We have handled these situations without a probation violation throughout the San Francisco Bay Area. Sometimes the prosecution wants the violation but we have yet to have a Judge disagree with our arguments. If your probation order was to abstain from the use of intoxicants it is more difficult but, again our office has been very successful at preventing probation violations under these facts.

Unless you are required to test & you tested positive then that would be something to worry about.? Otherwise, no one (in an official capacity) really knows you had consumed alcohol do they? My advice, don't let anyone else know that.

Depending upon the terms of your probation, that is if there was a prohibition of your consumption of alcohol, there is a high probability that you will be violated for the drinking in public charge.

The benefit of unsupervised probation is that once you have fulfilled the prerequisites for the DWI, they shouldn't find out about the new citation. Appear on the citation and continue the case until after your probation expires. Then use an attorney or Public Defender to assist you with the new citation. You need to find out another way to relax.
