Asked on Feb 04th, 2013 on Expungements - Missouri
More details to this question:
I am 17 and a senior in high school and I have been charge with a class c felony (theft) and a class c felony (tampering) and I was wandering if I plead not guilty if the prosecuting attorney would try and make a plea bargain like misdemeanor and 1-5 years probation. If not can my public defender ask or hint around about a plea bargain? Thanks.

You will have to hire an attorney to represent you to negotiate a plea bargain with the prosecutor. It's not the prosecutor's job to give you a good deal, so if you are not represented by an attorney, the prosecutor will try to get you convicted and sentenced to the highest fine and longest amount of time in jail that he can get. Keep in mind that, at age 17, you are an adult in the eyes of the law. If this is a state violation, then you can ask the judge to appoint a public defender. If it's not a state violation and these charges have been issued by a municipal court, then you won't get public defender. Public defenders only work on state cases.
