QUESTION

Will there be a fine or jail time for giving false name to officer?

Asked on Dec 05th, 2013 on Criminal Law - New Jersey
More details to this question:
My boyfriend was in a vehicle being driven by his friend when they got pulled over for a taillight being out. The officer asked for his name and he gave his middle name which he goes by all the time instead of his frist. When the officer returned stating he could not find him in the system he stated that was his middle name and then proceeded to give his first. He was then arrested due to warrants. Will the false name accusation be a fine or jail time when he goes to court?

the use of the middle name is not the problem which will drive the consequence. the outstanding warrants will drive the consequences. what was the nature of the warrants ? how long were the warrants outstanding ? the answers to these questions, coupled with the 'false name' will dictate what happens. he should address all warrants asap and apoligize. please let me know if we can help. ed dimon, esq. 732-797-1600
