Will there be jail time for petty theft from employer?

More details to this question:
If someone was confronted by company loss prevention about a missing bank deposit and that individual was questioned, who then admitted to taking bank deposit ($125) to cover drug addiction, and wrote a statement to this effect, is there a strong chance of serving jail time? Person is active in narcotics anonymous recovery program now, clean for 30 days. Total estimated taken from employer is $325-400. Person is over 50 years old. Court appearance in criminal court due in a month.

Instead of worrying about the jail time, you need to focus your attention on how you can avoid being convicted. Petty theft is a crime of moral turpitude, and if convicted it will really hurt your school/employment aspirations. You should talk to a lawyer, who may be able to work out a deal with the Judge whereby you can earn yourself a dismissal.
