QUESTION

Can I attach a judgment to a property?

Asked on Apr 30th, 2014 on Collections - Florida
More details to this question:
I loaned $10,000 to a couple, who said that they were using the funds to buy a motel in Alachua County, Florida to "fix and flip". The couple has defaulted on the loan. I am afraid that they will sell the property soon and not pay me back. Can I have an attorney file a lawsuit and, assuming a favorable judgment, file a lien against the motel? How much will it cost to have an attorney do this for me? Can I get reimbursement of attorney fees as part of the damages? Thanks for your help.

Possibly, though once the suit is filed and served, they may find ways to negate a judgment. You should have consulted with a lawyer about obtaining a mortgage.  If you have questions or would like to discuss this issue further, we do offer FREE consultations. Just call 1-800-922-6442.
