QUESTION

Can I re-sell a product?

Asked on Jul 18th, 2021 on Collections - Wisconsin
More details to this question:
A friend signed a promissory note that he would pay me $350 for a wheelchair in January. He said as soon as he gets his stimulus. He doesn't need it & just uses it for transportation. He spent his stimulus on other things & hasn't paid me anything. I'd like to put it for sale on craigslist or FB Marketplace. He has the chair but leaves it parked in the hallway outside his apartment door.

You asked if you can resell a product, which frankly has nothing to do with your situation.  No, absent a contract which gives you the right to do so (I assume your promissory note doesn't provide for this), you can't sell someone else's property just because you claim they owe you money.  You have to sue your debtor and, assuming you win and obtain a judgment, and he doesn't pay the judgment, you can then avail yourself of a number of different procedures to get your money, including auctioning off his property to pay the debt.
