Can I sue

More details to this question:
My car was parked and someone ran through he stop sign, he hit one car then hit me. He only has liability $10,000.00. They are only willing to give me $5,000.00. They said the car was totalled and is still in the shop. The bill for the shop as of right now is a little over $6,000.00 and I have rental bills as well. At this point I am ready to sue but not sure how to start and if I can win.

Depending on your total claim, and where the accident occurred, you need to sue in Supreme Court or County Court.
