Can I sue Wells Fargo

More details to this question:
My daughter and I received a check from Wells Fargo for a refund of payments on an auto loan that I co signed for. She wrecked the car before making a single payment and the bank sold the loan to a collection agency. The collection agency has been garnishing wages and taking money from bank accounts and now Wells Fargo has sent us a refund check and will send more when we show them we paid more to the collection agency, who is still taking money out of her checking account. The bank will not tell us what the administrative error was or even write the check in one of our names instead of both. I live in Alabama and my daughter lives in Oklahoma and the check is in our maiden and previously married name.

I'm not sure what your question is, but here are a few thoughts:  Was the car insured at the time of the wreck?  If so,  why were you sued?  For there to be a garnishment, there must have been a lawsuit...when & where was the lawsuit filed?  Who is the collection agency?  What are you trying to accomplish...stop the garnishment, figure out the balance, or something else?
