QUESTION

Car repossessed

Asked on Dec 21st, 2015 on Debtor and Creditor - Florida
More details to this question:
I had my vehicle repossessed in the middle of the night. I have personal items in the vehicle that have my name and bank account etc.. I am concerned about identify theft. The repo company is charging me astronomical fees to return my items. The fees increase each day and I can only retrieve them by appointment within a narrow window of time. My license plate is also on the car. I find this unlawful to withhold my personal items and charge me a ransom on their terms to return. I was never told that the repo was to occur at a certain time and please remove personal items.

Do you REALLY think that a repo agent is silly enough to tell you the "repo time?" They would never repo a single car. They should not be charging you for return of the personal items though they may be able to charge an inventory fee and possibly storage fees if you have not retrieved the items. Bottom line is, while your concerns about ID have merit, you obviously werent concerned enough about this to not keep your fincancial records in your car, let alone one that is subject to repo. You may need to retain a lawyer to address the repo companies compliance with the repo statute, BUT, this may cost you more than the personal items at issue.
