My Dad loaned money to his nephews in FL for their company. He mortgaged his home and took equity out. Since his death my Mom his paying that mortgage. He also maxed out his credit cards to give to his family. They started to pay back this death and when my Dad died they stopped. Since November 2012 they started to pay back monies in the amount of $700.00. My Mother sent me documents showing money they owe in the amounts totaling over $1 million dollars and climbing. From December to present I have sent them these documents but they won't respond to me, they have respoinded to my Mom and Brother only stating they are working on it. On March 4, 2012I sent an email stating some time has passed and I am requesting documents you have been working on to present it. Thay have not responded. Sent a second request today hoping to get an answer. Need advice on collecting this debt. Thank You.
First, since you Dad has passed, and it was a debt allged to be owed TO him, you, your mom or brother probably have no right or standing to demand payment from anyone. What most likely needs to happen is the establishment of an estate, and the personal representative or executor as some people call them, would have to take action to collect the monies or enforce repayment. The PR would then hire an attorney to secure recovery of the monies and if it is a verbal loan I would suspect quite a bit of litigation over the terms and conditions of repayment, since your father is not around to testify to the contrary unless the agreement is in writing.
