Do I need a form for getting money back for work not done

I had a contractor come out in reference to my dinning room and kitchen floor. He told me it was the product and it would have to be replaced. We scheduled for 9/24/17, and a $400 deposit was given to him for order of materials. I received a call on 9/23 that he was sick and he would call back to reschedule. I have called several times and not received any response. Check was cashed on 9/13.
