QUESTION

How can I get the collections removed?

Asked on Dec 29th, 2013 on Collections - Florida
More details to this question:
My ex and I rented an apartment when we were living In Ft. Pierce, Florida at The Sands. I was fully and legally signed off the lease by both my ex, Emily Eaton, and the apartment manager but have moved multiple times since then and I have misplaced my copy of the paperwork. The apartment complex has never contacted me, however I noticed on my credit report that they had sent a bill to a collection agency. I called them about their mistake, they informed me that it could take months to find my documents. Should I just wait? Should I dispute this with the credit report companies? Do I have any other legal options?

You should dispute this both under the FCRA and the FDCPA/FCCPA. You should also write a cease and desist letter to the collector and creditor sent certified mail, demanding that the collections effort stop and that they remove it from your credit report, detailing your reasons why. Other than this, you may have to wait to see what they do or what records are produced as your loss of the records showing you owe nothing is unfortunate. If you find those records, you would have a strong FCRA or FDCPA (improper collectons) case.
