How do I sue a company reporting false information on a public report

More details to this question:
I pulled my copy of my Early Warning Systems report (a company that reports bank account problems, similar to ChexSystems) and it is showing an account I did not have signing rights on, nor had access to. (It was for Social Security benefits, and the person who had signing privileges on this account over drew the account and it was closed for that matter). I spoke with the banks Loss Prevention Department and after research they said they would remove the negative entry from Early Warning Systems. They did not because it is still there.

Assuming that the information on the record is not about you, you need to send a letter to them, certified mail, return reciept requested, wherein you put them on notice of the error and ask them to correct it. If they have not done so within thirty (30) days, then you can file suit to make them remove it.
