QUESTION

How would I know?

Asked on Jul 30th, 2016 on Collections - New York
More details to this question:
How would I know if the collectors are monitoring my bank account and intending to take out money that might be deposited there in the future? How would I know if there are any judgements? I only see chargoffs on my credit report, not Judgements, but the chargeoffs showed up a month ago after I was receiving only collection calls for 4 years.

In order to "take out money" from your bank account, the creditor must have a judgment.  In order to have a judgment, the creditor must have sued you.  In order to have sued you, the creditor, by its attorneys, must have served youwith a Summons and Complaint.  Before any funds may be "levied" (taken from your account), the bank must give you 20 days to assert an exemption, although your account may be restrained (Frozen).
