QUESTION

lawyer is suing for late maintenance fee payments on my condo.

Asked on Feb 22nd, 2013 on Collections - New York
More details to this question:
Lawyer claims to have served me in 2007, for late payments which I HAVE NO ACKNOWLEDGEMENT OF. Fast forward to 2013, he calls me directly and tells me he is getting us evicted, If we don't make a large sum of payment. I have gone to my local District Court to see if it was filed. I have searched for 2 hours, haven't found anything so I went to the District Court Clerks office, the lovely lady helped me for 20 minutes and couldn't find any case or filings. This lawyer faxes me documents that I APPARENTLY received for being served, there is an Index# which he has blacked out. Is it illegal for a Lawyer to have me evicted and there is no case filed from 2007?

I think you should investigate whether he is even a lawyer! http://iapps.courts.state.ny.us/attorney/AttorneySearch Then call the management company and alert them that someone is posing as their lawyer and is trying to collect on money that is not owed claiming that it is arrears beyond the statute of limitations and providing false documentation!
