My husband's Ex-Wife can't put Mortgage on her name.

Mi husband's ex-wife got the house on their divorce many years ago. The mortgage is only in my husbands name. The divorce decree says about the house "her sole and seperate property, and the husband is divested of all right, title, interest, and claim in and to that property...Wife will remain in the house. She will be resposible for making mortgage and insurance payments, as well as any other costs related to this asset, such as maintenance and utilities. She will keep the property and will be the rightfull owner." The ex-wife has a lot of debt, some acquired while still mariried to my husband, and some being on her own. We have been paying those debts, but the house is her responsability. Because of her bad credit and being self-employed she is not eligble to refinance the morthage and put it on her name. We are stuck with this mortgage. We are afraid she might stop paying at some point and affect us. The home is in TX and we live in FL. What can we do?

Essentially nothing. Thats the deal your husband negotiated during the divorce and thats the deal he has. Short of bankruptcy discharging the mortgage, the ex wife is esentially paying the husbands debt on the mortgage. If she misses a payment, he will have to pay it or risk the default. He may want to hire a TX family law lawyer or a Florida bankrtupcy lawyer to discuss the details.
