QUESTION

My mom just got served with mediation from creditor

Asked on May 08th, 2014 on Collections - Florida
More details to this question:
My mother, whom is 64 and lives solely off of SS benefit, what just served with legal papers requesting mediation to solve a debt. However, between food and living expenses she does not have much left over from her monthly SS check. I have understood that creditors cannot garnish SS benefits, is this correct? What are her remedies in a situation such as this? May she be able to just go into mediation and state she lives of SS? I am attempting to be as prepared as possible before her mediation date in court.

If she is mediation, this means that she is beiung sued in court. She has to attend mediation or be subject to sanctions. If she is being sued, she would need to retain a lawyer to really address the issues you raised, and possibly a bankruptcy lawyer.
