notice requirement for debt in small claims debt dispute

More details to this question:
My fiance's ex bf decided that he wants to sue for for not paying him back on a promissary note and we where told that he was not able to do so until a certain amount of time had passed. However no one can tell us where to find that statute here in Florida. Basically he is claiming that she missed a payment on May 20th and filed a small claims case for the balance of the debt he is claiming on May 23rd. Does anyone know how much time is required before legal action can be taken on a debt and where I can find that statute to get the case dismissed?

There is no minimum time. If there is a breach of the agreement, its ripe for suit. There is also no "statute to get the case dismissed" as these are legal issue that really need to be addressed by a lawyer.
