QUESTION

NY-Levy on a bank account with no prior notice?

Asked on Sep 26th, 2013 on Debtor and Creditor - New York
More details to this question:
A levy was placed on my back acct for a medical bill that my husband owed from 2003. He was killed in Iraq almost 7 years ago. We were not married in 2003, and I have no prior knowledge of anyone trying to collect a debt let alone a judgement against me or the threat of the levy. Is this legal?

It sounds like your husband's name and SS# still appear on the account. If you provide the creditor's lawyer with proof of his death then they should lift the restraint on his account. Provide the death certificate to the bank as well to remove him from the account so that this does not happen again.
