QUESTION

Stipulation Agreement

Asked on Jun 24th, 2013 on Debtor and Creditor - New York
More details to this question:
A few years ago my credit card company sued me and I signed a stipulation in court to pay a certain amount. At the time I didn't have the same responsibilities as I do now and the amount I agreed to pay, I can no longer afford and am having trouble keeping up with the payments. I was younger and also had never been to court before and was a little intimidated by the Judge. Is there a way I can go back to court and get the monthly amount adjusted?

You cannot go back to court to modify a stipulation under these circumstances. However, if the stipulation was not subject to the entry of the judgment you should renegotiate with the law firm.
