QUESTION

Subpoena Duces Tecum for Deposition

More details to this question:
Hello: We(my wife) just received a "Subpoena Duces Tecum for Deposition" and are a little concerned about what exactly to do next. It states that we have to go for the deposition at the plaintiffs office I believe. and to bring with us bunch of paper work like tax records, pay stubs, etc. This is in Broward County, FL. So I have a question. 1) I know it states that if we fail to appear, we may be in contempt of court. What does that mean? From what I read on the web, you cant go to jail for civil matter cases. Is that true? And that the judge usually will award lawyer fees to the plaintiff if we miss the deposition. If that is the case, we can live with that. So what is the worst case scenario and what is the best case scenario? We really do not want to go because we plan on filing bankruptcy after we finalize our situation with the mortgage company for our house. We also don't want them to know where we work so that they can't garnish our wages. So any help will be greatly appreciated.

Sounds like a deposition in aid of execution and they are looking for that information because they have every intention of garnishing wages and seizing assets to satisify a judgment. If you plan on filing bankruptcy, you may want to step that process up and talk to bankruptcy lawyer ASAP. If you cant file BK ASAP, you may need to spend money to hire a lawyer to continue the depo a bit so you can. If you are looking to hire a lawyer you can call our office at 813-877-6442 to arrange for a FREE in office consultation.
