QUESTION

Unsecured Loan to a Friend

Asked on Jul 15th, 2013 on Collections - Florida
More details to this question:
I made a personal loan to a friend in the amount of $11,000.00 to prevent eviction. They have made one payment of $1,000.00; but since that payment have refuse any additional payment. Can I place a lien against their house, car, or property; garnish wage, seize personal items or any other items? Can I also garnish a child support check or a disability check when used as part of the overall income? What court do I file this in? What Is the best method proceed in this matter? Since I live out of state and they are in Florida how much of this can be done without me physically being on site.

You first need to obtain a final judgment against your friend for the amount owed. To do this you have to file a lawsuit. One cannot place a lien or garnish wages until one has a final judgment.
