QUESTION

What are the statute of limitations for payday loans

Asked on Mar 04th, 2016 on Collections - Tennessee
More details to this question:
I took out a payday loan in 2005-6 and filed Cahpter 7 bankruptcy in 2007. I am now getting calls from an agency for the payday loan stating I must repay that loan now. THey have called me, my ex in laws and family members. When I ask to give proof they tell me that I will be arrested for writing bad checks and breech of contract that the bankruptcy doesn't matter and they will continue calling me and all family members until they get their money. THey ask for my lawyers name and number so they can send the info to them but I do not have one

If you filed for Chapter 7 bankruptcy and listed the payday loan company as a creditor, then you would have gotten a discharge order. If you don't have a copy, you can contact the bankruptcy court where you filed your bankruptcy and get a copy of the petition and discharge order and send it to the payday loan company.
