When can I collect punitive damages from a company for a false credit reporting?

More details to this question:
I paid a balance on a Charter Communications bill which was paid 9/27/2013. It was debited from my account. I have contacted Charter several times over the last year and a half and they stated they would look into my situation. I have heard nothing from them for almost 8 months and now its a new negative on my credit report. I have been resolving this for a year and a half and I have paid my debt to them and they still reported it to credit agencies falsely. This has had a negative impact on credit I am trying to rebuild. Can I sue?
