about a divorce

More details to this question:
About 17 years ago my husband left me and kids about 1 year ago my son in law fimd him in Texas i ask him for a copy of the divorce. He could not or would not give me a copy. He got married in2002. I do not think we are divorced.

You may be correct that your husband never divorced you.  In that case, he is not legally married now.  If he is not forthcoming in sending you a copy of the divorce decree, or at least telling you where the divorce was entered (ie: the state and county-in which case you can get a copy of the divorce from the clerk's office), then perhaps your instinct is correct. If you are not divorced, then you could file for divorce yourself.  I am sure his new wife will be surprised when he gets the divorce papers as at that point she may realize that she is not legally married to him.

if you're former husband got remarried, he would have had to have been legally divorced in order to enter into the second, valid marriage. If you know what counties your husband has resided in, you can check with the clerk of court in order to determine whether or not he is filed for a divorce in those counties. Many of those counties presently have online services. You may also want to retain the services of a private investigator in order to conduct a records search to determine whether or not he had gotten married. Lastly, you can go ahead and file for divorce yourself against him, and require him to prove that you are presently divorced. Good luck.
