We have been married 22 years and my husband and I separated 5 months ago. My husband moved to another state. I was a stay at home wife and for the first 3 months he did send money to pay the bills but that stopped 2 months ago. H says he will be filing for divorce but so far he has not. My question is, can I file for alimony now, before he has filed for divorce? P.S. I am currently going to school so that I can get enough income to sustain myself and we have no children.
Either party may file, you may file in Florida and request alimony. If he files first be careful as some states do not have alimony, for example Texas.
Consult with an attorney to determine your best option, because if has not filed for divorce yet, you may be better-off filing an action for support without dissolution of marriage, or filing for dissolution of marriage yourself. A consultation with an attorney would include discussion of the specifics of your situation and your options.
Without filing for divorce yourself at this stage, there is no case under which you could get alimony. You have a long term marriage and need to go have a full discussion with a local family attorney, in private.
